1. Acceptance of these terms
By creating an account, reserving an ad slot, or using The Big Ass Card (the "Service"), you ("Merchant") agree to be bound by these Terms of Service ("Terms"). If you don't agree, don't use the Service.
2. The Service
The Big Ass Card provides a platform for reserving advertising slots on oversized direct-mail postcards distributed by USPS to homes in defined geographic markets. Each market consists of carrier routes summing to approximately 10,000 residential deliveries. We print and mail the cards; you provide the artwork and a destination URL for your QR code; we track scans on your behalf.
3. Reservations and payment
Slot reservations are first-come, first-served. Submitting a reservation creates a binding payment authorization for the listed slot price, charged at the time of submission via Stripe. Reserving a slot does not guarantee your artwork will be accepted — The Big Ass Card reserves the right to reject artwork that violates these Terms (see §5).
4. Refunds
Refunds are issued at The Big Ass Card's discretion. Once a mailing has been printed and dropped at USPS, the slot fee is generally non-refundable. Pre-print refunds release your slot back to the market inventory and refund the full amount to your original payment method.
5. Content standards
You're responsible for the content you supply (artwork, destination URLs, landing-page text and contact info). Content must not: (a) violate any law; (b) infringe intellectual-property rights; (c) be obscene, hateful, harassing, or deceptive; (d) promote illegal goods or services; (e) impersonate another person or business. The Big Ass Card may remove or refuse content for any reason consistent with these standards.
6. Intellectual property
You retain all rights to artwork and content you supply. You grant The Big Ass Card a non-exclusive, royalty-free license to print, distribute, and host that content as required to provide the Service. The Service itself — software, design, scan-attribution data — remains the property of The Big Ass Card.
7. Scan data and analytics
The Big Ass Card records each QR-code scan (timestamp, anonymous device user-agent, approximate IP-based location). We share aggregated scan counts with you through your merchant dashboard. We do not share individual scan details with third parties except as required by law.
8. Disclaimers
The Service is provided "as is" without warranty of any kind. The Big Ass Card does not guarantee any particular scan rate, conversion rate, or business outcome. Mail delivery is subject to USPS performance and may vary.
9. Limitation of liability
To the maximum extent permitted by law, The Big Ass Card's aggregate liability arising out of or relating to these Terms or the Service shall not exceed the total fees you paid in the twelve (12) months preceding the claim.
10. Termination
Either party may terminate your account at any time. Termination doesn't entitle you to a refund of fees already paid for mailings that have been printed or dropped.
11. Changes to these Terms
We may update these Terms periodically. When we make material changes, we'll notify you by email and require re-acceptance before your next reservation. The version you accepted at signup is recorded on your account.
12. Governing law
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Howard County, Indiana.
